What Happens When Someone Passes Away with No Known Family?

When someone dies and no family or next of kin can be located, the goal is to handle the death with compassion and dignity.  Locally, the case will most likely be referred to the Orange County Public Administrator (PA). The Public Administrator is responsible for making a diligent effort to identify and notify relatives, secure the deceased person’s property, and administer the estate when no qualified person is available to do so. 

A PA case begins when law enforcement, a hospital, a care facility, or another agency reports a death and there is no known next of kin or no one able or willing to make funeral arrangements. The Public Administrator investigates the case by searching public records, contacting possible relatives, and locating any will or estate planning documents.  They may speak with neighbors, canvas the local area and use available public databases to find out what they can.

While the search is underway, the deceased is cared for according to set procedures. Funeral homes often work closely with the Public Administrator during these cases, coordinating transportation, managing the required documentation, and cremation or burial once legal authorization has been provided. If no family can be found – or if the family is unable or unwilling to take responsibility – the Public Administrator may oversee the estate. If there are no assets available, the county will provide a dignified disposition in accordance with California law and available resources.
